1. Consent to Terms of Use

This platform is the property of Quote Wise Insurance, or one of its affiliated or subsidiary entities (referred to collectively as "Quote Wise," "we," "us," or "our"). These Terms of Use are applicable to our various online properties, including QuoteWiseInsurance.com. QuoteWiseInsurance.com, as well as any other platform that includes a link to this page (collectively, the "Platform"). By accessing our Platform, you are agreeing to abide by these Terms of Use ("Terms") and allowing Quote Wise to collect, utilize, and share your information in accordance with our Privacy Policy or any additional terms linked to these Terms. 2.Ownership of Platform Content

Unless explicitly stated otherwise, all images, including digital, printed, and video images, and any other visual or textual elements, as well as the overall design and structure of the Platform (referred to collectively as "Platform Content"), are safeguarded by the copyright laws of the United States and other jurisdictions. Quote Wise owns or holds licenses for all Platform Content. Reproduction, modification, redistribution, or any other form of usage of Platform Content is strictly prohibited without obtaining written permission from the relevant owner of the Platform Content.

3. Utilization of Platform Content

You are granted a limited, non-exclusive, non-transferable, revocable license to access and display the Platform Content on your personal computer or mobile device for personal, non-commercial, and educational purposes. However, copying, transferring, broadcasting, or any other form of usage of the Platform Content for public or commercial purposes is expressly prohibited.

4. Reservation of Rights

All rights not explicitly granted by Quote Wise are reserved. Nothing within the Platform or these Terms shall be construed as granting, either expressly or implicitly, through estoppel or otherwise, any right or license to utilize any Platform Content or materials of any third party. Quote Wise does not have the authority to grant any license on behalf of any third party.

5. Quote Wise Trademarks

The trademarks associated with Quote Wise, including but not limited to "Quote Wise," "Quote Wise Senior," the Quote Wise logo, and other marks found on the Platform (collectively referred to as the "Marks"), are the exclusive property of Quote Wise. Unauthorized use of the Marks is strictly prohibited without prior written consent from Quote Wise.

6. Third-Party Trademarks

Trademarks of third parties may appear on the Platform from time to time. Use of these trademarks without the prior written permission of their respective owners is not allowed. It is acknowledged that nothing on the Platform grants, expressly or implicitly, through estoppel or otherwise, any right or license to use any of these trademarks, nor does it imply that Quote Wise has the authority to grant any right or license on behalf of any third-party trademark owner.

7. Restrictions, Limitations, and Usage Conditions

Any unauthorized use of our Platform or Platform Content for any purpose is prohibited. Your access to this Platform is contingent on your compliance with these Terms. Prohibited activities include but are not limited to:

(1) accessing, soliciting, collecting, or using any personally identifying information about other users of the Platform or any third party;

(2) restricting or inhibiting others from using the Platform;

(3) transmitting viruses, harmful software, or making any modifications to the Platform or engaging in any reverse engineering, decompiling, disassembling, or modification of any Platform source or object code;

(4) submitting content that is threatening, abusive, defamatory, obscene, vulgar, offensive, or objectionable, or has an advertising, political, promotional, or other commercial purpose;

(5) engaging in activities that interfere with another user's access to the Platform or disrupt the proper operation of the Platform; or

(6) distributing or copying Platform Content manually or using any automatic device or process such as robots, scrapers, or crawlers.

While Quote Wise is not obligated to monitor your interaction with the Platform, we reserve the right to review or monitor the Platform and any user submissions at our discretion.

8. Links to Other Platforms

In the course of using the Platform, Quote Wise may provide hyperlinks to one or more third-party websites (the "Linked Platforms"). These links are offered for your convenience, and Quote Wise is not responsible for the content of, or links to and from, the Linked Platforms. Your decision to link to these Linked Platforms is at your own risk. It is recommended to review the terms and conditions and privacy policies of the respective Linked Platforms, as your use of those platforms will be subject to their terms of use and privacy policies. A link from the Platform does not indicate a relationship with or endorsement of the Linked Platform(s) or its content, purpose, policies, or business practices by Quote Wise.

9. Disclaimer, Limitation of Liability, and Indemnification

The materials, Platform Content, and services provided on the Platform are presented "AS IS" and without warranties of any kind. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of non-infringement, merchantability, and fitness for a particular purpose. We do not guarantee that the use of the Platform will be uninterrupted or error-free, that defects will be corrected, or that the Platform or the server(s) making it available are free of viruses or other harmful components. We also do not warrant or represent the correctness, accuracy, availability, reliability, graphics, links, or any other aspect of the Platform or any information contained therein, including Platform Content. 10. Ability to Accept Terms

By using the Platform, you affirm that you are of the age of majority in your jurisdiction and have the capacity to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to comply with them. The Platform is not intended for individuals under the age of eighteen (18). If you are under 18 years of age, please refrain from using this Platform.

11. Data Processing in the United States

Wise processes data in the United States, and we make no representation that this Platform is suitable or available for use outside the United States. If you access this Platform from other locations, you do so at your own discretion and are responsible for compliance with local laws regarding online conduct and acceptable content. Certain programs and services described on this Platform may be available only in the United States or specific regions. We reserve the right to limit access to the Platform and/or the provision of any content, programs, service, or feature described on this Platform to any person, entity, geographic area, or jurisdiction, at any time and at our sole discretion. 12.Choice of Law and Forum

These Terms will be governed by and interpreted in accordance with the laws of the State of Kansas, without giving effect to any principles of conflicts of law. All disputes arising under or connected with the use of this Platform shall be exclusively litigated in the state and federal courts of the State of Kansas, and in no other court or jurisdiction. By using this Platform, you submit to the jurisdiction of the state and federal courts sitting in Overland Park, Kansas.

13.Severability and Enforceability

If any provision or part of these Terms is deemed illegal, invalid, or unenforceable, it shall be modified to the minimum extent necessary to correct any deficiencies or replaced with a provision that is legally permissible and closely aligns with the invalidated or unenforceable provision. This shall not impact the legality, validity, or enforceability of any other provisions or parts of these Terms.

14.Termination/Exclusion

We retain the right, at our sole discretion, to revoke, terminate, or suspend any and all privileges associated with accessing the Platform for any reason, including improper use of the Platform or failure to comply with these Terms. We may also take any other action we deem appropriate.

15. User Suggestions

Any questions, comments, suggestions, ideas, feedback, or other information provided by you to Quote Wise through the Platform are not confidential, and you grant us a worldwide, perpetual, royalty-free license to distribute, publish, modify, edit, or otherwise use your submissions. Quote Wise shall have the unrestricted use and dissemination of these submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

16. Changes to Terms

We may modify these Terms at any time, with or without notice, by updating this page. Such modifications will be effective upon posting to this page. Quotes, policies, and plan comparisons and information provided are sourced from individual insurance companies, are subject to change without notice, and may require underwriting qualification by the specific insurance company receiving the application. A quote does not guarantee the issuance of the policy or any other policy. All presented quotes are based on information you provided at our request. You are responsible for ensuring that the information you provide in connection with any quotation or inquiry through the Platform is accurate and up-to-date.

To secure an insurance policy, you must submit a completed application to the insurance company. The insurance company will review and underwrite your application, including information from sources such as the Department of Motor Vehicles, credit bureaus, and the Medical Information Bureau. Following this review and underwriting analysis, the insurance company will determine your eligibility for insurance and the specific premium for the policy you seek. The underwriting process may result in premiums different from those provided in your quote.
